This circular explains the new statutory provisions relating to opencast coal. The effect of the legislative changes is that the British Coal Corporation (BCC) will continue to seek planning permission from mineral planning authorities but will no longer require authorisation from the Secretary of State.
Compulsory acquisition by BCC of temporary rights of occupation and use of land for opencast coal mining will however continue to be subject to confirmation by the Secretary of State. BCC may also apply to the Secretary Of State for suspension of non-vehicular rights of way.
