\n1.3. By accessing, using or requesting a Report through the Service, you agree to be bound by these terms. Information about how we process personal data in connection with the Service is set out in the Planning Portal Privacy Notice.

\n4.1. The Service is currently only available for property addresses within England.
\n4.2. The Service is designed to support homeowners and other users during the early stages of householder development projects by providing indicative planning feasibility insights.
\n4.3. Users can only access the Service through their existing Planning Portal account.
\n4.4. To generate a Report, Users will be required to:
\n4.5. A Report is generated using information supplied by the User together with Third-Party Data including planning policy information, planning history, site constraints, property characteristics, comparable planning activity and other available datasets.
\n4.6. A Report is generated using automated processes and AI Technology supplied by PlanningHub.
\n4.7. Users may be able to search, view, download and access previously generated Reports through their Planning Portal account.
\n4.8. The Planning Portal does not guarantee that the Service or previously generated Reports will be continuously available, uninterrupted, error-free or available at all times.

\n5.3. We reserve the right to amend, suspend, increase, decrease or otherwise vary usage limits at any time.
\n5.4. We may suspend or restrict access where we reasonably believe:
\n5.5. There may be instances where the Service fails to provide a Report due to a system and/or software failure. Where this occurs, the User shall be notified immediately that a Report cannot be generated and is advised to contact the Planning Portal Service Desk for assistance.

\n6.4. You must independently verify any information contained within a Report before:
\n7.1. The Service uses AI Technology and automated data analysis to generate Reports.
\n7.2. AI-generated outputs may contain errors, inaccuracies, omissions, outdated information or conclusions that may not reflect all relevant planning considerations.
\n7.3. Not all planning constraints, site-specific matters, material considerations or local circumstances may be identified by the Service.
\n7.4. The Service is intended to provide general planning insight only and should be regarded as a preliminary research tool.
\n7.5. The Service does not replace professional judgement, site inspections, local planning authority advice or independent legal and professional advice.
\n7.6. By using the Service, you acknowledge and accept the inherent limitations of the AI Technology used and accept that the Report may sometimes produce incomplete or inaccurate results.

\n11.1. Nothing in these terms shall affect the User’s statutory rights under applicable law. Except as expressly stated in these terms, the Planning Portal, PlanningHub and their respective officers, employees, agents, contractors and licensors do not give any additional non-statutory representation, condition or warranty in relation to the Service and Reports generated.
\n11.2. The Planning Portal, PlanningHub and any Third-Party Data providers do not guarantee:
\n11.3. To the fullest extent permitted by law, neither the Planning Portal nor PlanningHub are responsible for losses resulting from the decision made by the User solely on the basis of the Report generated without seeking independent professional verification in accordance with the provisions of clause 8.
\n11.4. To the fullest extent permitted by law, neither Party shall be liable for:
\n11.5. Nothing in these terms excludes or limits liability for:
\n12.1 The User shall be responsible for and shall reimburse the Planning Portal for any reasonable losses, costs, expenses or liabilities incurred as a result of:
\n12.2. Nothing in this clause shall require a User to indemnify the Planning Portal for losses that were not reasonably foreseeable, or which arise from the Planning Portal's own negligence, fraud or breach of these terms.

Further information about the categories of personal data processed, the purpose and lawful bases of processing, recipients, international transfers, retention periods and your rights is provided in the Planning Portal Privacy Notice.
\n13.3. The Planning Portal and Planning Hub will implement appropriate measures to protect personal data in accordance with applicable law.
