Written representations

Most planning appeals are decided by the written representations procedure.

Written representations are split into two separate procedures, Part 1 and Part 2. The procedure used depends on what type of decision is being appealed. The Planning Inspectorate can decide whether an appeal should follow a different procedure.

Part 1 is an expedited procedure where the planning inspector will consider the application as it was submitted to the local planning authority. Any original comments made in respect of the planning application will be included in the inspector’s considerations.

Part 2 is a more detailed process where the main parties can submit a statement of case. This will normally apply to appeals regarding non-determination of an application, listed building consent or discontinuation notices.

There are strict timeframes for when the various written submissions must be submitted, and these will be set out in a letter from the Planning Inspectorate when the appeal is validated.

You should also note that in the case of householder appeals there is a slightly different process.

The planning inspector will consider all the written evidence that is made available and will also visit the site, sometimes accompanied by the main parties. However, no verbal submissions are permitted at any time - even on the site visit.
