Applications to discharge planning conditions
LPAs can exercise their discretion about whether to consult the BSR about the discharge of a condition, depending on the relevance of the condition(s) to fire safety matters.
If the BSR is requested to provide advice in relation to the discharge of a condition on an application for which it was not a statutory consultee (because it was validated before 1 August 2021), the BSR will usually return a “no comment” response because it has not had an opportunity to assess the development as a whole.
As a national regulator in England, the BSR is not able to confirm compliance with local plan policies, including London Plan policy requirements related to fire safety in tall residential buildings. This is a matter for the LPA and/or Greater London Authority.
